The Control of Asbestos Regulations (2006) regulations place a legal duty on the 'duty holder' of all non-domestic premises and common areas of domestic premises to manage asbestos. The Regulations require the identification, management, routine monitoring of the condition and the maintenance of the asbestos material to ensure that it remains in a safe condition. The regulation also requires the 'duty holder' to hold an up-to-date asbestos register and to have an asbestos management plan in place.
Management should include a survey to identify the presence and condition of (suspect) ACM, routine monitoring of the condition of the ACM and maintenance programme, training of personnel at risk of exposure and removal/abatement of asbestos considered high risk.
Asbestos containing material does not necessarily need removal when identified. Some ACMs, such as asbestos cement cladding, pose little risk to human health when properly maintained and managed and only requires routine visual monitoring as part of a site's asbestos management plan. In addition, encapsulation combined with a visual monitoring programme, removes the risk to human health.
